Update on NBPCB Activities

Dear NOMC, The NBPCB has been fervently working during the past several months to securely ensure that our Procedures and Code of Conduct transparently reflect the expectations and standards of behavior that the Board demands from all of its certificants. Because of this, we wanted to reach out and give you an update on all the changes we have made, and we invite any questions you may have for us. Our goal is for all of us, working together, to provide the most beneficial training and protection for our consumers in the safest and most engaging environment possible. Our Board has adopted a new Code of Conduct for all of our Structured Discovery (SD) professionals. The new code went into effect in April of this year, and everyone, even if they have not already signed, is obligated (by virtue of holding one of our SD certifications) to abide by this new code. Our 2021 code is based on many of the tenants of our previous code, that of CRC, and the American Counseling Association. We also sought feedback from both the professionals and centers we certify. In addition to the actual Code of Conduct, we have also revised our grievance process and reporting mechanisms. All of these documents have been thoroughly reviewed by legal counsel and can be found in their entirety on our website, http://www.nbpcb.org <http://www.nbpcb.org/> . We encourage each of you to familiarize yourself with these documents and to reach out to us if you have questions or just want a little more clarification. We would like to point out one very important change that we feel will help us ensure that we are in a much better position to obtain information regarding possible infractions to our code. SD professionals who hold certification from NBPCB must now allow us to speak to both present and former employers; colleagues; current or former consumers; schools, colleges, or institutions of higher education; vocational rehabilitation agencies; groups; programs; volunteer organizations; and membership organizations regarding relevant details necessary to investigate possible violations to our code. This will ensure that we can seek information without someone invoking privacy laws that prohibit them from sharing information. Moreover, those seeking Structured Discovery certification or recertification will now undergo background checks. Although this will be a new practice for us, we want to be sure that everyone understands that background checks will only indicate if someone has a criminal history and will not inform the board if someone has engaged in behavior that either has not been reported to authorities or that does not rise to a violation of the laws of a particular state. Our website will soon have the option to search the status of any SD professional we have currently or previously certified. Only the professional's name, state on file, certification status, and expiration date will be displayed. Therefore, the only information that will be publicly displayed about an individual's certification is that it is active, expired, or revoked. NBPCB has also entered into a Memorandum of Understanding with the National Federation of the Blind to share information regarding any persons being investigated for possible violations of the NFB or NBPCB codes of conduct to facilitate clear and consistent information sharing. This was necessary because NBPCB and NFB are two distinct organizations with no legal ties to one another. We will be entering into similar agreements with any center which we certify so that there will be no delays in reporting possible violations to our Code of Conduct and information can be shared with greater assurance that no privacy laws interfere with this necessary flow of communication. All NBPCB board members, NOMCT committee members, and certified center directors underwent training by RAINN-the nation's largest anti-sexual misconduct organization-and another organization, WEEVE, another organization working in the area of sexual misconduct prevention. Information regarding how to contact RAINN has been included on our website and in our grievance documents for anyone who may be a victim of sexual misconduct. We continue to encourage each of you to reach out either on this listserv or to us directly at our admin at nbpcb.org address with any questions or concerns. We want to be sure that you are informed as to what we have been doing and the rationale behind our efforts to protect the certification that each of you has worked so hard to obtain and maintain while also providing protections and remedies for those whom we serve. Assisting in a Parental Rights Case

Hi everyone, We have a parental rights crisis in Vermont, and I have the opportunity to assist. Our national office is involved, and we are working on all the legal processes that we can. I am going to describe the scenario and why I am helping as an NOMC. I want to ask you all to share any wisdom or experiences that you may have, either on or off list, that may help me to be effective. I'd like to ask that list members avoid talking about this with others off list as much as possible. I'll let you know when the baby is back in her mother's custody and when it becomes another public story. This is my understanding of the situation. A blind woman, about my age, has recently lost her vision. She's been largely in denial and trying to function with her residual vision. She has never used a cane and has never been offered any kind of blind services, even after her eye doctor diagnosed her legally blind. She was walking the front of a business, in the fire lane, with her 3-month-old baby in a stroller. A semi truck, moving at about the same pace as her, was driving parallel to her. Somehow, they merged together, and the front wheel of the stroller got crushed by the tire of the semi truck. The baby was fine, but ultimately the state child welfare agency found out about the incident from the police and raided her home to take the baby. She gets to visit her daughter twice per week as they wait for an October 7 hearing. There is no reunification plan yet. The child welfare agency is claiming that, because the mother does not use any kind of mobility device, the baby is in eminent danger, and thus they cannot allow her to keep her child. She wants to use a cane, but she has not had the opportunity to receive instruction. We do not know what else they will throw at her in the hearing, but one thing is for sure: someone needs to teach her how to use a cane. That person will be me. Here is my plan for tomorrow: We will meet up at a small indoor shopping mall about the size of the Pecanland Mall in Monroe, LA. We will eat lunch at the attached Applebee's first, my treat, and just talk about life, hopes and dreams, and basic blindness philosophy. Part of my job here is welcoming her into a family of 50,000 blind people who will have her back. I will also talk with her about VR and the possibility of attending an NFB training center. Her sister, who she lives with, has been a huge support and could possibly care for her baby while she is in training if she decides that. Then, we'll begin working on using a cane. Thankfully, I have one to give her. I am thinking to do this much like we would a cane walk at national convention. It's a crash course with the goal of getting her comfortable with a cane so that she will keep using it. We might even go shopping for a new stroller, one that she can pull behind herself. Shopping will be a nice activity to do with the cane once she gets a little practice, including the part about going up to people in public spaces with a clear identifier that she is blind. We can do indoor and outdoor travel, especially good when the forecast is about a 50% chance of thunderstorms. I'll give her a few extra cane tips and show her how to change them. If any of you have extra thoughts on this, I'm happy to hear them. The part where I start to feel more uncertain is where my limits are on how I can help in an expert witness capacity, formally or informally, to advocate for her in her process of getting her kid back. The remedy for this situation should not have been to take her baby; it should have been to call a cane travel instructor right away. I believe that, as an NOMC, I am qualified to speak to the realities of blindness and how blind people can walk safely and independently, including with a stroller. I even know of some blind people who get strollers with an awning so that they can pull it like a sidecar on a motorcycle, but I think this new traveler is better off pulling a stroller behind her. We'll see how she does. What will be more important, I suspect, is being able to speak to this particular blind person's capacity for safe travel. I think I know how to articulate my thoughts and feelings about a student's abilities. Have any of you ever written some kind of formal statement of your understanding of a student's cane travel skills to justify them to a court or government agency? I feel like I will be asked if I've done an assessment. I think the answer will be yes because we are always assessing our students as we are working with them. The NOMA is really aimed at kids right now, unless I'm behind on some updates, so I don't really have any other assessments that I should use. If someone has an idea on this, I would be especially grateful. My hunch at the moment is to say what I just said, that we as instructors are always assessing our students, and my professional credential says that I know how to construct a wholistic understanding of the capacity of my students. I don't want to wield the NOMC inappropriately, but I think it makes me the right kind of authority figure to help this newly blind mother get her baby back. O&M Job Opportunity at the NJ Commission for the Blind

Hi y?all, I wanted to let you know that I am imminently transferring out of my position as an itinerant teacher with the NJ Commission for the Blind to their training center, so my position will be available. So here is a list of some pros and cons about the position. If any of you want to talk more about the job, please contact me at 973-440-0649. A master?s degree is not a prerequisite ? Driver provided by the agency who is assigned to you ? This is a state job with union protection and very good health insurance and retirement benefits ? Opportunity to teach folks of all ages and backgrounds, many of whom are unable to attend residential training ? The job offers you a lot of independence to work your case load as you see fit (no one is watching over my shoulder to see if I do things ?the right way?) ? Conventionally trained staff across disciplines have been very open to my ideas and are overall excited about me being on board ? Opportunities to introduce SDCT content into statewide meetings (Tarik and Joanne were a hit at our last O&M statewide meeting) ? Job is located in Newark: a major city, which itself is just two short train stops away from Midtown Manhattan o Plenty of places to live in or near Newark that are very walkable and offer access to trains, buses, and multiple light rails Cons ? Large case load (I have just over fifty clients at this moment) ? Unable to work with most clients more than twice a month (excepting school orientations and other time-sensitive things) ? Although NFB products are bought without any political issue, you will be buying supplies with three other conventional O&M?s from the same money pool ? Dealing with headaches that come from working in a hierarchical, state bureaucracy (e.g. communication issues with supervisors) ? You will also be managing certain client?s agency-wide cases on top of teaching O&M ? You and I would be the only NOMC?s working at the agency at present One last thing: two of my colleagues are also looking to transfer because they live so far from the office, so please feel free to send your resume to my supervisor at any time.
